Terms of Use
Last updated October 13, 2026
The short version (not a substitute for the full text):
- Your music stays yours. You give us only the permissions we need to play it on Demo Jail and promote it there.
- Only upload songs you wrote and recorded (or have written permission for). No covers without a license.
- Be decent: no harassment, hate, spam, or gaming the charts.
- You can delete your songs or your whole account at any time.
- Demo Jail is a small, independent project provided as is. Tennessee law applies.
1. Who we are and agreeing to these terms
Demo Jail (demojail.com, the "Service") is an independent service operated from Tennessee, USA ("Demo Jail", "we", "us"). By using the Service, including just listening, you agree to these Terms and to our Privacy Policy, AI policy and the rules described in our FAQ. If you don't agree, please don't use the Service. If these Terms conflict with the AI policy or the FAQ, these Terms win.
2. Who can use Demo Jail
- You must be at least 13 years old. Accounts of people under 13 are closed when we learn of them.
- If you are under 18, a parent or legal guardian must review and agree to these Terms for you.
- You must be 18 or older to buy a sponsorship or make any other payment.
- If you use Demo Jail for a band or business, you confirm you're allowed to act for it, and these Terms apply to it too.
3. Your account
Give accurate information, keep your login private, and tell us at hello@demojail.com if you think someone else is using your account. You're responsible for activity on your account. One person, one account; don't share or sell accounts. We may reclaim or change display names or band names that impersonate someone or are offensive.
4. Your music and other content
"Your content" means anything you upload or post: songs, artwork, clips, voice recordings, mixtapes, chat messages, posts, profile details and so on. You keep all ownership of your content.
So that we can run the Service, you give Demo Jail a non-exclusive, worldwide, royalty-free license to:
- store, copy, convert (for example to MP3) and stream your content on the Service, including radio, charts, band pages, search, mixtapes;
- let other users listen to, rate and share links to your content, and include your published songs in their mixtapes on the Service;
- show your band name, song titles, artwork, short excerpts and public stats to promote Demo Jail and your music, for example in social media posts or share previews.
This license ends when you delete the content or your account, except that copies may stay in our providers' backups for up to 30 days, and promotional posts already published don't have to be taken down. Comments and chat messages you post may remain visible in context until deleted.
We will not sell your music, and we will not use it or let anyone else use it to train AI that generates music or voices. We may check uploads for signs that a song is AI-generated, and we transcribe voice recordings (mixtapes, sponsor messages) to check them for abuse; see the Privacy Policy.
5. What you can upload
By uploading, you promise that:
- you own or control all rights to the recording and the song (lyrics and music), or have written permission from everyone who does, including bandmates, producers and any samples. Cover songs are not allowed unless you have a written license that covers streaming on Demo Jail;
- anyone whose name, voice or image appears in your content has agreed to it;
- you've marked songs as explicit or AI-made where that applies (see the AI policy);
- no one (such as a label, publisher, union or rights organization) is owed money by Demo Jail because of your upload.
Demo Jail does not currently pay royalties and does not collect money for artists. If your songs are registered with a performing rights organization, make sure your agreement with it allows you to put them on a free, ad-supported service.
6. Rules of conduct
Don't use Demo Jail to:
- post anything illegal, hateful, harassing, threatening, sexually explicit involving minors, or that encourages violence or self-harm;
- infringe anyone's copyright, trademark, privacy or publicity rights, or impersonate anyone (including AI voice clones of real people without permission);
- manipulate plays, ratings, favs, charts or rotation, for example with bots, multiple accounts, paid listeners or rating swaps;
- send spam or unsolicited ads;
- copy, download, rip or scrape songs or data, or build a competing service from them;
- hack, overload, probe or get around security or limits, or access accounts or data that aren't yours.
Chat, posts and other text are checked automatically, and we review reports. We may remove content, mute or ban accounts, or take songs out of rotation if we believe these Terms are broken. Where we reasonably can, we'll tell you why. If you think we got it wrong, email hello@demojail.com.
7. Rotation, charts and stats
How songs are picked, scored and ranked is explained in the FAQ. We tune those settings over time. Rankings, badges and stats are for fun and discovery; they are not guarantees, awards of any legal value, or measures of commercial performance, and we may correct them if they're wrong or manipulated.
8. Copyright complaints
If you believe something on Demo Jail infringes your copyright, use the Report button or send a notice to our designated agent with: your contact details; the work you own; a link to the material on Demo Jail; a statement that you believe in good faith the use isn't authorized; a statement, under penalty of perjury, that your notice is accurate and that you own or are authorized to act for the copyright owner; and your physical or electronic signature. This follows the U.S. Digital Millennium Copyright Act (DMCA).
Designated agent: Copyright Agent, Demo Jail, 9029 Tedford Lane, Knoxville, TN 37922-6422, phone (865) 566-7970, email copyright@demojail.com.
If your content was removed and you believe that was a mistake, you can send a counter-notice to the same agent with your contact details (name, address and phone), the removed material and where it appeared, a statement under penalty of perjury that it was removed by mistake or misidentification, your consent to the jurisdiction of the federal district court for your address (or Knox County, Tennessee if you're outside the U.S.), your agreement to accept service of process from the person who sent the original notice or their agent, and your physical or electronic signature. We close the accounts of repeat infringers. False notices or counter-notices can make the sender liable for damages.
9. Sponsorships and payments
Businesses can sponsor the radio (see Advertise). Sponsor messages are reviewed before they run and must follow the rules shown when you create them. A sponsorship books a share of the ad breaks in an area for the weeks you choose; we don't promise a number of plays or listeners. Payments are processed by Stripe. Sponsorships are non-refundable once paid, except where the law requires otherwise or if we cancel a sponsorship ourselves for reasons other than a breach of these Terms. Prices and the details of what you get are shown before you pay.
10. Other services
Demo Jail links to and embeds other services, including YouTube, whose videos can play in mixtapes through YouTube's own player. By watching YouTube content on Demo Jail you agree to the YouTube Terms of Service, and Google's Privacy Policy applies to that player. Signing in with Google is subject to Google's terms. We don't control other services and aren't responsible for them.
11. Deleting your account; ending access
You can delete songs at any time and your whole account from Account > Delete my account. We may suspend or close accounts that break these Terms or the law, or that put other users or the Service at risk. We may also change, pause or shut down all or part of the Service; if we shut the whole Service down for good, we'll give at least 30 days' notice on the site and by email to account holders, so you can save anything you need. Sections 4 (for content already shared), 8, and 12 to 15 continue after your account ends.
12. No warranty
Demo Jail is a small, independent service provided "as is" and "as available", without warranties of any kind, including fitness for a particular purpose, availability, accuracy or non-infringement, to the extent the law allows. Content is posted by users; we don't endorse it and aren't responsible for it. Keep your own copies of your music: we don't guarantee we'll keep anything you upload.
13. Limitation of liability
To the extent the law allows, Demo Jail won't be liable for indirect, incidental, special, consequential or punitive damages, or lost profits, data or goodwill, and our total liability for any claim relating to the Service is limited to the greater of US$100 or what you paid us in the 12 months before the claim. Nothing in these Terms limits liability for fraud, gross negligence, willful misconduct, death or personal injury caused by negligence, or anything else that can't be limited by law. Some places don't allow these limits, so they may not fully apply to you.
14. Your responsibility to us
If someone makes a claim against Demo Jail because of your content or because you broke these Terms or the law, you agree to cover the reasonable costs of that claim, including legal fees, to the extent the claim is caused by you. We'll tell you promptly about the claim and give you reasonable help (at your cost). You may handle the defense with a lawyer we reasonably approve, but you can't settle in a way that admits fault for us or puts obligations on us without our written consent, and we may take part with our own lawyer at our own cost.
15. Law and disputes
These Terms are governed by the laws of the State of Tennessee and applicable U.S. federal law, without regard to conflict of law rules. Before filing a claim, please email hello@demojail.com so we can try to resolve it informally within 30 days. Any lawsuit must be brought in the state or federal courts located in Knox County, Tennessee, and you and we consent to their jurisdiction. Either side may bring a claim in small claims court instead if it qualifies.
16. Changes and the rest
We may update these Terms. If a change is significant, we'll tell signed-in users on the site or by email before it takes effect; continuing to use Demo Jail after that means you accept the new Terms. If part of these Terms can't be enforced, the rest still applies. Not enforcing a rule isn't a waiver of it. You can't transfer these Terms; we may transfer them to a successor, such as a company formed to run Demo Jail. These Terms, with the documents linked above, are the whole agreement between you and us about the Service.
17. Parental controls
Pursuant to federal law (47 U.S.C. § 230(d)), we notify you that parental control protections (such as computer hardware, software, or filtering services) are commercially available that may assist you in limiting access to material that is harmful to minors. Information identifying current providers of such protections is available from the FTC at consumer.ftc.gov/articles/parental-controls.
